Never mind that the earlier trials were judged by experts to be illegal interception of communications under the RIPA.
Never mind the pack of lies the spyware guys churn out about how innocent they are.
Here is some news.
What they are not saying is that they will be looking at everything you do online, they will be spoofing the web sites you look at, and altering the cookies from those web sites to have their own cookies hidden in them, and they will do anything they damn well like with all your communications. IF YOU LET THEM.
If you see anything asking you if you want to have much nicer advertisements, or similar sweet talk, watch what you click on. I suggest that you click on NO. Then, change your ISP to one that does not spy on everything you do online, one that does not change the cookies from web sites you trust, so that they have hidden stuff from Phorm in them. In short, watch out, there is SPYWARE about.

A few months ago - yes, months - I asked my ISP, which is one of the 3 known to be involved with Phorm, for a letter setting out its position on Phorm.
I'm still waiting.
Recently I rang them for an update and was told that my request hadn't been done, it was still sitting there in the system with no-one doing anything with it, but they couldn't explain why.
Funny that.
